Terms of Service

These Terms of Service ("Terms") govern your use of Pulzera, a heartbeat monitoring service. By creating an account or using the service, you agree to these Terms.
1. The service
Pulzera lets you create monitoring checks that receive HTTP pings from your scheduled jobs, evaluate them against your rules, and notify you when something goes wrong. The exact feature set available to you depends on your plan; see Pricing.
2. Accounts
- You must provide accurate, current information when creating an account.
- You are responsible for safeguarding your password, passkeys, and recovery codes. We will never ask for your password by email or phone.
- You are responsible for all activity under your account.
- One person or legal entity per free account; you may invite team members where your plan supports it.
3. Acceptable use
You agree not to:
- Use the service to send unsolicited communications (spam) via alert channels.
- Send pings at a rate intended to abuse the service or affect other users.
- Attempt to gain unauthorized access to other accounts, the underlying infrastructure, or data not belonging to you.
- Use the service to monitor or attack third-party systems without authorization.
- Reverse-engineer or scrape the service in ways that bypass plan limits.
- Upload illegal content, content that infringes others' rights, or content prohibited by law.
We may suspend or terminate accounts that violate this section. Where possible, we will give you a chance to remedy the violation first.
4. Plans, pricing, and billing
- Pricing is published on /pricing and may change with at least 30 days' notice for existing subscribers.
- Refunds: no refunds for partial periods; cancel anytime and you'll have access until end of the paid period.
- Taxes (VAT) are added where required by law and shown on your invoice.
- Failure to pay: if we can't charge your card or wire-transfer is not received we will first try to contact you to resolve the situation. If situation is not resolved or we don't receive any response, the account is downgraded to the free tier and paid features become unavailable.
5. Trials
We offer trial periods for new accounts. Trials end at the stated date; if you do not subscribe, your account reverts to the free tier (no data deletion).
6. Your content
You own the content you submit to Pulzera (check configurations, ping payloads, alert destination details). You grant us a limited, non-exclusive license to process, store, and transmit that content solely to provide the service.
You are responsible for what your pings contain. Request bodies, headers, and the caller IP address are captured only if you enable capture for a check. If captured payloads contain personal data of your own users, you confirm you have the legal right to send it to us; see the Privacy Policy. On plans that support it, captured headers and body payloads can be encrypted at rest with AES-256-GCM.
7. Service availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (DNS, payment processor, email provider), and force majeure events may cause downtime.
We may change, suspend, or discontinue any feature or part of the service. Where a change materially reduces what a paid plan includes, we will give at least 30 days' notice.
8. Disclaimer of warranties
The service is provided as is and you use it at your own risk. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or 100% accurate in detecting failures of your monitored systems, and alert delivery depends on third-party channels (email, webhooks and other notification providers supported by our application) that we do not control.
Pulzera is a monitoring aid, not an emergency service. Do not use it as the sole alerting mechanism for systems whose failure could endanger life, health, or property.
9. Limitation of liability
To the maximum extent permitted by law, our total aggregate liability under these Terms is limited to the fees you actually paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption, even if we knew such damages were possible.
In particular, to the maximum extent permitted by law, we are not liable for losses caused by missed, delayed, false, or undelivered alerts, by lost or unprocessed pings, or by decisions you make in reliance on monitoring results.
Any claim under these Terms must be brought within 12 months of the event giving rise to it, unless your local law mandates a longer period.
Nothing in this section limits liability that cannot be limited under applicable law (e.g. for gross negligence, willful misconduct, or personal injury).
10. Indemnification
You agree to indemnify and hold us harmless against third-party claims arising from your content (including ping payloads), your use of the service in breach of these Terms, or your violation of law or third-party rights, including reasonable legal fees.
11. Termination
- You may terminate your account at any time from Account > Security.
- We may terminate or suspend your account for material breach of these Terms, with reasonable prior notice where practical.
- We may suspend the service immediately and without prior notice where necessary to protect the service, other customers, or to comply with law.
- We may deactivate free accounts that have not been used for more than 12 months. Where we have a working email address, we will send a warning before deactivation.
- We may suspend or deactivate accounts involved in misuse of the service, creation of multiple accounts to evade plan limits or abuse free tiers, or other bad-faith behavior.
- We may close accounts we are legally prohibited from serving (for example, persons or territories subject to sanctions).
- Upon termination, your data is handled per our Privacy Policy (anonymized within 30 days; records required by law retained longer).
12. Force majeure
Neither party is liable for a failure to perform (other than payment obligations) caused by events beyond its reasonable control, including natural disasters, war, terrorism, labor disputes, internet or utility failures, or acts of government.
13. Changes to these Terms
We may update these Terms at any time without individual notice. The current version is always available at this page, with the "Last updated" date at the top. It is your responsibility to review these Terms periodically; continued use of the service after an update constitutes acceptance. We may, at our discretion, additionally announce changes by email or in-app notice.
14. General
If any provision of these Terms is found unenforceable, the rest remains in effect and the provision applies to the maximum extent permitted. These Terms are the entire agreement between us regarding the service. We may assign these Terms as part of a merger, acquisition, or sale of assets; you may not assign them without our consent. Not enforcing a provision is not a waiver of it.
